CONTEST OFFICIAL RULES

This promotion is intended for play and participation in the United States only and shall be construed and evaluated according to the laws of the United States.  Please do not enter this contest unless you are a legal resident of the 50 United States or the District of Columbia and 18 years of age or older.

CrimsonCup® Barista for a Day Contest
OFFICIAL RULES 

1. ENTERING THE CONTEST: NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Beginning February 6, 2008 at 6:00 AM Eastern Standard Time (“EST”), enter the CrimsonCup® Barista for a Day (the "Contest") only one way:
1) Via the Internet: During the Contest Period, log on to the www.barista4aday.com website to read the contest requirements and Official Rules.  Eligible entrants may submit the online registration form found on the contest website, www.barista4aday.com.
Online entries submitted must be received by 5:00 pm EST on February 29, 2008.  In the event of a dispute regarding the identity of the person submitting the entry, entry will be deemed submitted by the person identified on the web entry form, provided that person meets all eligibility criteria. CrimsonCup is not responsible for any Internet access or usage.  

2. CONTEST REQUIREMENTS: Any eligible entrant as defined below should complete the online registration form on the website www.barista4aday.com to be entered.
Only one entry per eligible entrant/e-mail address permitted.   The entrant must reside in the United States as defined above.
The entrant is responsible for all travel costs involved if selected as the winner.

3. CONTEST PERIOD: The Contest begins on February 6, 2008 at 6:00 AM EST, and ends on February 29, 2008, at 5:00 PM EST (the "Contest Period").

4. ELIGIBILITY: The Contest is open only to legal residents of the fifty (50) states of the United States and the District of Columbia, who are 18 years of age or older. Employees of CrimsonCup®, subsidiaries, directors, officers, advertising, promotional, or fulfillment agencies of or contracted by any of the foregoing individuals or entities, ("Contest Entities"), and immediate family members (parent, child, sibling and spouse of each) and/or persons living in the same household of any of the foregoing individuals are not eligible.

5. WINNER SELECTION: On or about March 1, 2008, CrimsonCup, whose random selection will be final and binding, will random select, based on the criteria described above, one winner. The winner may have his or her name, city and state displayed on the www.barista4aday.com and www.crimsoncup.com websites for a period of one year after the prize is awarded.

6. PRIZE: You and Armando will spend part of the day running the CrimsonCup coffee shop in Clintonville, OH (Columbus, OH) and part of the day learning the details of what goes into making the coffee from tree to cup at the CrimsonCup Headquarters also located in Columbus, OH.  Travel and expenses will not be included and will be the sole responsibility of the winner.  CrimsonCup reserves the right to market the winner nationally based on hometown success, without further compensation to the winner.

7. WINNER NOTIFICATION: The winner will be notified by telephone and will be required to sign and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of notification. If Sponsor is unable to contact a prize winner despite Sponsor's reasonable efforts to do so, prize will be forfeited.  Return of any prize notification or prize as undeliverable will result in forfeiture of prize and selection of alternate winner.

8. INTELLECTUAL PROPERTY RIGHTS: By entering the Contest, entrants acknowledge and agree that they do not have and will not acquire any trademark rights, copyrights, or any other rights in or to Sponsor's trademarks, trade names, logos or other intellectual property.  Sponsor specifically reserves all its rights to protect its intellectual property against any infringement or other illegal or improper use.
By submitting an Entry, you agree that your disclosure is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligation, that is free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waiver any rights to use similar or related ideas previously known to Sponsor, or developed by its employee, or obtained from sources other than you.  

9. GENERAL CONDITIONS: All federal, state, and local laws and regulations apply to this Contest. No prize transfers, cash redemption or substitutions permitted except in the event of unavailability of prize(s), in which case Sponsor may, in its own discretion, substitute a prize of equal or greater value. All federal, state and local taxes on prizes, if any, are the sole responsibility of the winner. The Contest is also subject to these Official Rules. If you cannot or will not comply with these Official Rules, you should not enter or participate in the Contest. By entering this Contest, Entrants agree to be bound by these Official Rules and to waive any right to claim any ambiguity or error in these Official Rules or the Contest itself. Entrants agree to be bound by all decisions of the Sponsor or its designees, whose decisions are final and binding.  Submission of entry constitutes permission for Sponsor to use the winner's name, city and state, for all advertising, trade, or promotional uses, without further compensation, worldwide and in perpetuity, in all forms of media, now known or hereafter devised, except where prohibited by law.

10. PRIVACY POLICY: Sponsor employs cookie technology to provide a record of participant's visit to the Website, including information such as User Name, time of last visit, pages viewed, etc. Any such information will be securely stored on separate servers, and neither this information, nor any other personal information of Entrants received by mail or otherwise obtained in connection with the Contest, will be sold to an outside organization. Information received through the website may be used by Sponsor in the aggregate to track usage patterns and customer base. Cookies can only contain as much information as a participant discloses to the Sponsor and cannot get information from participant's hard drive against participant's will, destroy files, or send viruses.

11. DISCLAIMERS: By entering the Contest, each Entrant releases the Contest Entities from all responsibility or liability for damages, losses or injuries of any kind resulting from participation in the Contest or any prize-related activities, or any awarding, possession, use and/or misuse of any prize(s) awarded herein. Sponsor shall not be responsible or liable for the late delivery of or the failure to deliver any prize due to circumstances beyond Sponsor's control. Entrant agrees that Contest Entities will not be responsible or liable for any entries which are not in compliance with these Official Rules, for multiple entries, or for any late, lost, or misdirected entries or data transmission.  Contest Entities are not responsible or liable for any injury or damage to Entrants' or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this Contest. Contest Entities are not responsible for failures of mail or other delivery services, or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the procession of the entries in this Contest.  Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest if the Contest is not capable of running as planned due to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of Sponsor.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it determines to be tampering with any entry mechanism, to be violating the Official Rules, or acting in a disruptive manner.  By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules.  By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Ohio.
